Terms of Service
By accessing, registering for, purchasing a subscription through, or using the Site or the Sportall365 Service, you agree to be bound by these Terms of Service (the “Terms”). These Terms govern your access to and use of the Sportall365 Service and, where you purchase a paid subscription, form part of the binding contract between you and Sportall365. Please read these Terms carefully before completing a purchase. Nothing in these Terms excludes, restricts, or limits any consumer right or protection that cannot lawfully be excluded, restricted, or limited under applicable law.
1. About Us
1.1 Sportall365 is a subscription-based digital sports content service providing subscribers with access to a Sports Magazine Pass and other sports-related digital content and features through supported Internet-connected devices and web browsers (the “Sportall365 Service”). The Sportall365 Service may also include recommendations, editorial materials, schedules, statistics, and other sports-related information.
1.2 The Sportall365 Service is provided by Sportall365 (“Sportall365”, “we”, “us”, or “our”). Company details are set out in Section 24. Sportall365 is responsible for subscriptions and billing entered into directly through the Site, except where a third-party platform expressly controls the relevant subscription or billing relationship.
2. Key Terms of Use
2.1 Sportall365 provides digital sports content, which may include sporting-event highlights, editorial materials, sports information, and other related digital content (collectively, “Content”). Content availability may vary according to territory, licensing rights, subscription level, device, technical availability, scheduling, or other restrictions.
2.2 Promotions, introductory prices, trials, discounts, or special membership packages may be subject to additional conditions presented with the applicable offer. Such conditions add to these Terms and do not reduce any payment or cancellation provision of these Terms. Any description of an offer as “free”, a “free trial”, or a “free day” refers only to the regular membership price; the $0.70 first-day service fee described in Section 4.9(b) still applies.
2.3 Sportall365 may amend these Terms for legitimate legal, regulatory, security, technical, operational, or service-related reasons. Amendments will apply to existing memberships only to the extent permitted by applicable law and subject to any legally required notice, consent, or cancellation rights. No amendment will retrospectively alter a completed payment or remove a contractual or statutory right that has already accrued. The applicable Terms version will be determined by the relevant contractual circumstances and any mandatory legal requirements.
2.4 The Sportall365 Service and Content are supplied solely for personal, private, and non-commercial use. Subject to these Terms, Sportall365 grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Service and Content during an active membership. No ownership or intellectual-property rights are transferred to you.
2.5 Your membership and continued access are conditional upon successful payment of the amounts due under your membership and compliance with these Terms. You must use a Payment Method that you are legally authorised to use.
2.6 Information relating to Content usage may be shared with applicable licensors, rights holders, payment providers, service providers, or competent authorities where reasonably necessary for rights management, reporting, security, fraud prevention, contractual compliance, payment processing, dispute handling, or legal compliance, subject to our Privacy Policy and applicable data-protection law.
2.7 Sportall365 may suspend or terminate a membership where reasonably justified by material breach of these Terms, payment failure, fraud, abuse, security risks, legal or regulatory requirements, or other legitimate grounds. Sportall365 may also terminate a membership without customer fault upon reasonable advance notice where permitted by applicable law. Suspension or termination arising from the customer’s material breach or unlawful conduct does not, by itself, create a contractual entitlement to reimbursement. Where Sportall365 terminates a prepaid membership without customer fault and does not continue supplying the paid Service for the remaining period, Sportall365 will provide any refund or credit required by applicable law.
3. Free and Promotional Periods
3.1 Where Sportall365 offers a free, discounted, introductory, or promotional period, its price and the price that applies afterwards are set out in these Terms. Offers may be subject to eligibility, territorial, account, or time restrictions, including a restriction to one introductory offer per customer.
3.2 A membership continues automatically after the free, introductory, or promotional period at the regular price set out in these Terms, and your Payment Method will be charged that price when it falls due unless you have completed cancellation before that payment is processed.
4. Financial and Membership Terms
4.1 Any fee or charge that your bank, card issuer, payment provider, Internet provider, or any other third party adds to a payment or to your use of the Sportall365 Service, including currency-conversion fees, foreign-transaction fees, exchange-rate differences, and international or cross-border charges, is your sole responsibility. Such fees and charges are not set or received by Sportall365, are not part of the price, and are not refunded or reimbursed by Sportall365.
4.2 Prices are stated and charged in US dollars. Prices displayed to consumers include taxes to the extent required by applicable law. Charges independently imposed by a bank, card issuer, payment provider, telecommunications provider, or another third party are outside Sportall365’s control.
4.3 Payment may be made using any Payment Method accepted by Sportall365 at checkout. Payments are processed by our payment service providers. By providing a Payment Method and completing a purchase, you confirm that you are authorised to use that Payment Method, and you authorise Sportall365 and its payment service providers to store it and to charge it, without further action on your part, for the payments that fall due under your membership as described in Sections 4.9 and 4.10: the initial payment, the recurring membership payments, the membership-conversion payments, and the renewal payments, in each case in the amounts and at the times set out in these Terms. Every payment remains subject to validation and authorisation by the relevant payment provider. Where a payment attempt fails, Sportall365 may make reasonable further attempts to collect it, unless you have completed cancellation before a further attempt is successfully processed.
4.4 Sportall365 may decline or refuse a payment where reasonably necessary for payment security, fraud prevention, regulatory compliance, technical reasons, or inability to validate or authorise the Payment Method.
4.5 Sportall365 memberships are recurring subscription arrangements. A membership may run on a monthly, annual, or two-year membership term and may be converted from one term to another only as expressly described in Section 4.10. When you purchase a membership, you agree to the recurring arrangement described in Sections 4.9 and 4.10, including the payments described in Section 4.3. A membership conversion changes the active membership and its billing term within the same recurring arrangement; it does not create a second, separate membership.
4.6 Your membership status, billing information, payment history, and the cancellation function are normally available in the account area of the Site (“My Account”). Where a third party controls the subscription, the applicable information and functionality may instead be provided by that third party.
4.7 Sportall365 may change membership prices or plans from time to time. A new price applies from the first payment that falls due after the new price is published on the Site. No price change alters a payment already successfully processed.
4.8 Where Sportall365 makes a membership-suspension feature available, the suspension and restart conditions will be disclosed when that feature is selected. Unless cancelled before the scheduled restart, a suspended membership resumes automatically on the disclosed terms.
4.9 Premium and All-Access Memberships
4.9(a) Premium+ (including News Premium+): the introductory payment is $9.90 for the introductory period shown at checkout. At the end of the introductory period the membership continues at the regular price of $39.80 per monthly billing period, charged at the start of each billing period, unless you have completed cancellation before that payment is processed or the membership has been converted under Section 4.10.
4.9(b) All-Access (including News All-Access): a service fee of $0.70 is charged for the first day of access. From the following day the membership continues at the regular price of $39.80 per monthly billing period, charged at the start of each billing period, unless you have completed cancellation before that payment is processed or the membership has been converted under Section 4.10.
4.9(c) The introductory payment or first-day service fee, the regular monthly price, the automatic continuation of the membership, the automatic membership conversions, their standard prices, and the prorated-credit calculation are set out in these Terms, which you accept at checkout. If a payment fails and cannot be collected, access ends at the end of the last period that has been paid for, and the membership may then be cancelled.
4.9(d) If you believe a payment has been duplicated, incorrectly calculated, or processed without authorisation, you may contact Sportall365 support for investigation. Confirmed billing or payment-processing errors will be corrected as required by applicable law. A validly authorised and correctly calculated subscription, renewal, or membership-conversion payment does not become a billing error merely because the customer subsequently cancels, does not use the Service, or changes their mind.
4.10 Automatic Membership Conversion and Prorated Credit
4.10(a) A monthly membership (Premium+, News Premium+, All-Access, or News All-Access) becomes eligible for conversion to a Premium Annual Membership once three (3) successful payments have been made under that membership. The $9.90 introductory payment or the $0.70 first-day service fee counts as one of the three. A payment that has been fully refunded or reversed does not count. Eligibility depends only on the number of successful payments and not on the time that has passed: because the first payment covers an introductory period, three successful payments may be reached in less than three calendar months. Once the membership is eligible, and for as long as it remains active and you have not completed cancellation, Sportall365 may convert it to a Premium Annual Membership at any time. Sportall365 is not obliged to convert any membership.
4.10(b) The standard Premium Annual Membership price is $477.60 for twelve (12) months, unless changed in accordance with Section 4.7. The conversion payment is the standard price less a prorated credit for the unused part of the current monthly billing period. The prorated credit equals the price charged for that billing period multiplied by the time remaining in that billing period at the moment of conversion, divided by the total length of that billing period, calculated to the second by our payment processor. No credit arises for time already elapsed. The Premium Annual Membership term begins at the moment the conversion payment is successfully processed (the “Annual Activation Date”) and runs for twelve (12) months. The monthly billing period ends at the same moment, so the same period of time is never paid for twice.
4.10(c) A Premium Annual Membership becomes eligible for conversion to a Premium Two-Year Membership as set out in this Section 4.10(c). The six-calendar-month period is calculated from the start of the current Premium Annual term (the Annual Activation Date or, after a renewal under Section 4.10(k), the date of that renewal). The Premium Two-Year conversion window begins ten (10) calendar days before the end of that six-calendar-month period and continues until the end of that Premium Annual term. Sportall365 may process the Premium Two-Year conversion at any time during that conversion window, before or after the end of the six-calendar-month period, while the Premium Annual Membership remains active and you have not completed cancellation. Sportall365 is not obliged to convert any membership.
4.10(d) The standard Premium Two-Year Membership price is $955.20 for twenty-four (24) months, unless changed in accordance with Section 4.7. The conversion payment is the standard price less a prorated credit for the unused part of the Premium Annual term. The prorated credit equals the price charged for that Premium Annual term multiplied by the time remaining in that term at the moment of conversion, divided by the total length of that term, calculated to the second by our payment processor. The Premium Two-Year Membership term begins at the moment the conversion payment is successfully processed and runs for twenty-four (24) months. The Premium Annual term ends at the same moment, so the same period of time is never paid for twice.
4.10(e) A conversion under this Section replaces the preceding membership within the same recurring arrangement. The preceding membership and the converted membership never run at the same time as separate paid memberships, and any unused prepaid value of the preceding membership is credited as described in Sections 4.10(b) and 4.10(d).
4.10(f) You may cancel your membership at any time in My Account. Cancellation completed before a conversion payment is successfully processed prevents that conversion and every later conversion. If you cancel a Premium Annual Membership before it is converted, it remains available until the end of its already-paid twelve-month term, subject to Sections 2.7 and 7.2, and is not renewed. Not accessing, viewing, or using the Sportall365 Service does not constitute cancellation.
4.10(g) If a conversion payment has been successfully processed before you complete cancellation, the conversion stands. Your later cancellation stops renewals and any further conversion, and, subject to Sections 2.7 and 7.2, you keep access until the end of the converted membership term you have paid for, but the later cancellation does not by itself reverse the completed conversion or create a contractual right to a refund of the conversion payment. This is subject only to any mandatory consumer right that cannot lawfully be excluded.
4.10(h) The payment authorisation in Section 4.3 includes the Premium Annual conversion payment and the Premium Two-Year conversion payment, in each case after deduction of the prorated credit.
4.10(i) A conversion is completed only when its conversion payment is successfully processed. If the conversion payment is declined or fails, no conversion takes place and the existing membership continues unchanged for its already-paid period; no fee is charged for an unsuccessful attempt. Sportall365 may make reasonable further attempts while the conditions of Section 4.10(a) or 4.10(c), as applicable, continue to be met.
4.10(j) If a provision of Section 4.10 cannot lawfully be applied to a particular customer, it applies to the fullest extent permitted by law and the remaining provisions continue to apply.
4.10(k) At the end of its term, a Premium Annual Membership or a Premium Two-Year Membership renews automatically for a further term of the same length at the then-current standard price (currently $477.60 for twelve months or $955.20 for twenty-four months), unless you complete cancellation before the renewal date. The renewal payment is covered by the authorisation in Section 4.3.
4.10(l) Sportall365 may send a confirmation of a conversion or renewal to the email address associated with your account, and invoices are available in My Account. Whether or not a confirmation is sent or received does not affect the validity of the conversion, renewal, or payment.
4.11 Digital Service Delivery and Records
4.11(a) “Site” means the Sportall365 website or websites on which these Terms are displayed. “Service” means the Sportall365 Service. “Content” has the meaning given in Section 2.1. “Payment Method” means an accepted payment method used for the applicable membership. “Billing period” means the period covered by a recurring payment (one month for monthly memberships, twelve months for Premium Annual, and twenty-four months for Premium Two-Year).
4.11(b) Access to the Sportall365 Service ordinarily begins following successful membership activation. Where applicable law permits a statutory withdrawal or cooling-off right to be lost following commencement of digital supply, such loss applies only if all legally required conditions have been satisfied, including any required express consent, acknowledgement, and contractual confirmation. Commencement of digital access does not remove any mandatory statutory right or remedy that remains applicable under the relevant law.
4.11(c) Subject to our Privacy Policy and applicable data-protection law, Sportall365 creates and keeps records reasonably necessary to administer memberships, demonstrate the terms agreed, establish the membership and payment history, demonstrate the availability or use of the Service, investigate account or payment issues, prevent fraud, and respond to bank, payment-network, regulatory, or legal disputes. These records may include account-creation information, the version of these Terms accepted and the time of acceptance, checkout information, membership status, successful and unsuccessful payment records, conversion and prorated-credit records, cancellation records and timestamps, communications, login records, IP address information, device information, and Service-access records. They are kept only for as long as is set out in our Privacy Policy or required by law.
4.11(d) You are responsible for taking reasonable measures to protect your account credentials and for activity and payment arrangements that you have authorised. If you suspect that your account has been compromised or that your Payment Method has been used without authorisation, you should promptly notify Sportall365 at [email protected] and, where appropriate, your payment provider. An allegation of account compromise, stolen payment credentials, or unauthorised activity does not, by itself, establish that a particular subscription payment was unauthorised or create an automatic contractual entitlement to a refund. Such claims may be investigated using relevant and lawfully retained account, authentication, transaction, and payment records. Nothing in this provision excludes any mandatory right or remedy relating to genuinely unauthorised transactions.
5. Cancellation, Termination and Refunds
5.1 You may cancel your membership at any time using the cancellation function in My Account. Cancellation is completed when you confirm it there. A cancellation request sent by email or by any other means is completed only when Sportall365 has processed it. Cancellation stops every renewal, recurring payment, and membership conversion that has not already been successfully processed before cancellation is completed. Cancellation does not reverse a payment, renewal, or conversion processed before cancellation was completed. Subject to Sections 2.7 and 7.2, you keep access until the end of the period you have already paid for.
5.2 Where a membership was purchased through a third party that controls the subscription or billing relationship, cancellation must be completed through that third party’s subscription-management functionality.
5.3(a) Except where a refund, reimbursement, or other remedy is required by applicable mandatory law, Sportall365 does not provide contractual refunds for validly authorised, correctly calculated, and successfully processed subscription, renewal, or membership-conversion payments solely because the customer subsequently cancels the membership, changes their mind, does not access or use the Service, is dissatisfied with the Service or available Content, or finds that the Service or Content does not meet their personal expectations, assumptions, preferences, or anticipated experience. Such subjective dissatisfaction or unmet expectations do not, by themselves, establish a contractual entitlement to a refund. Payments relate to the applicable paid membership period and are not retrospectively reversed solely for these reasons. Nothing in this provision excludes any mandatory statutory remedy for a failure to provide the Service in accordance with applicable legal requirements.
5.3(b) Cancellation prevents future recurring charges, renewals, and membership conversions that have not already been successfully processed. Unless applicable mandatory law requires otherwise, cancellation does not create a contractual entitlement to a refund or prorated reimbursement for an already-paid membership period. Access ordinarily remains available until the end of the applicable paid term.
5.3(c) Non-use, inactivity, failure to log in, or failure to view available Content does not constitute cancellation and does not independently establish a contractual refund entitlement. Suspected duplicate, incorrectly calculated, or unauthorised payments are handled under Section 4.9(d) and applicable law.
5.3(d) Nothing in this Section excludes or restricts any mandatory statutory consumer right or remedy that cannot lawfully be excluded or restricted. This provision preserves applicable statutory protections but does not independently establish an unconditional contractual entitlement to a refund.
5.3(e) Sportall365 may, at its discretion, provide a voluntary goodwill refund or credit in circumstances where no refund is otherwise legally required. Any such voluntary refund or credit is specific to the relevant case and does not establish a general contractual entitlement, precedent, or obligation to grant equivalent voluntary refunds in other cases. This discretion does not affect any reimbursement or other remedy required by applicable law.
5.4 Payment Disputes, Chargebacks and Fraud Prevention
5.4.1 If you believe that a payment was incorrect, unauthorised, or associated with compromised account or payment credentials, you may contact Sportall365 at [email protected] for investigation. Sportall365 may review relevant evidence, including subscription acceptance, payment authorisation, transaction history, authentication records, and account activity, subject to applicable law. A customer’s allegation alone does not establish that a validly authorised transaction was fraudulent or require Sportall365 to provide a voluntary contractual refund. Confirmed errors and genuinely unauthorised payments will be handled in accordance with applicable law and payment-network requirements. Nothing in these Terms restricts any lawful right to contact a bank, card issuer, payment provider, regulator, or other competent authority.
5.4.2 Where a payment is disputed, reversed, or charged back, Sportall365 may suspend access to the Service until the dispute is resolved, to the extent permitted by law, and may preserve records reasonably necessary to investigate or respond to the dispute. If the dispute is resolved in your favour, the membership period covered by that amount is treated as unpaid; if it is resolved in Sportall365’s favour, Sportall365 may restore access for the paid period or exercise its rights under Section 7.2.
5.4.3 Sportall365 may respond to a payment dispute through the applicable bank, payment processor, card network, or other dispute-resolution process and may provide accurate and relevant records concerning the transaction, including these Terms and the checkout disclosures, acceptance records, membership history, payment records, conversion and prorated-credit records, cancellation records, communications, account status, login information, IP address or device information, and records relating to the availability or use of the Service, to the extent permitted by applicable law.
5.4.4 Where a payment is reversed after the corresponding Service has been supplied, Sportall365 may exercise any recovery, access-restriction, or payment-risk remedy lawfully available to it, including declining future purchases. Sportall365 does not charge you any fee or penalty because you raised a dispute, and nothing in this Section creates a right to recover any amount that applicable law does not permit.
5.4.5 Sportall365 may investigate suspected fraud, account sharing, payment abuse, unauthorised account access, or misuse of the Service and may take proportionate protective measures where reasonably necessary and permitted by law.
6. Technical Requirements and Service Availability
6.1 You are responsible for maintaining compatible hardware, software, Internet access, and other technical requirements necessary to access the Sportall365 Service.
6.2 Content schedules and availability may change because of licensing restrictions, event changes, technical failures, rights-holder requirements, or circumstances outside Sportall365’s reasonable control. Sportall365 is not responsible for the cancellation, postponement, or interruption of any sporting event, or for any event or programme not being shown as scheduled.
6.3 Sportall365 may temporarily suspend all or part of the Service where reasonably necessary for maintenance, upgrades, security, rights management, or technical reasons.
6.4 To the fullest extent permitted by applicable law, no warranty or condition is implied beyond those that cannot lawfully be excluded or restricted.
6.5 If you experience a problem with the Sportall365 Service, contact Sportall365 support so that it can be investigated.
6.6 Display quality and Service performance may vary depending on device capability, location, Internet connection, bandwidth, technical restrictions, and other relevant factors.
6.7 A download speed of approximately 9.0 Mbps or greater is recommended for certain Content. Your Internet provider may impose separate data charges.
6.8 Software, functionality, technical requirements, and features may differ by browser or device and may depend upon third-party software or licences.
7. Use of the Sportall365 Service
7.1 Sportall365 and/or its licensors own or control the intellectual-property rights in the Service and Content. You agree:
- 7.1.1 to use the Service only for personal, private, non-commercial purposes;
- 7.1.2 to keep your account and its credentials personal to you and not to share them with, or make them accessible to, anyone else;
- 7.1.3 not to copy, record, retransmit, redistribute, stream-capture, resell, or publicly perform Content except where expressly permitted by applicable law;
- 7.1.4 not to circumvent technical protection measures, decompile, disassemble, or reverse engineer the Service except where applicable law expressly permits such activity;
- 7.1.5 not to commercially share, sell, distribute, or otherwise exploit access credentials or Content, not to charge others for viewing, and not to show Content to the public;
- 7.1.6 not to use a VPN, proxy, or other means to hide your location or to get around territorial restrictions;
- 7.1.7 not to create more than one account, or use another person’s details or payment method, to obtain an introductory offer more than once; and
- 7.1.8 not to use the Service unlawfully, fraudulently, maliciously, or in a manner that infringes third-party rights or materially interferes with operation of the Service.
7.2 Sportall365 may suspend, restrict, or terminate access where reasonably necessary and proportionate to address suspected fraud, payment abuse, material breach of these Terms, unlawful activity, account sharing, security risks, or requirements imposed by law, competent authorities, payment providers, or rights holders. Sportall365 may also refuse future purchases where lawful and reasonably justified. Suspension or termination does not independently create a contractual refund entitlement merely because access is restricted following the customer’s material breach or unlawful conduct. Any mandatory statutory consumer rights or remedies remain unaffected.
7.3 Unless otherwise stated in the applicable offer, an active membership permits simultaneous use on a maximum of two (2) devices.
7.4 Content may be added, removed, replaced, rescheduled, restricted, or otherwise changed because of licensing, rights, editorial, technical, operational, or legal requirements. No specific item of Content is guaranteed to remain continuously available unless applicable law requires otherwise.
7.5 Names, marks, logos, designs, programme titles, and other intellectual property belonging to sports organisations, clubs, broadcasters, licensors, or other rights holders remain the property of their respective owners.
7.6 Member Points
- 7.6.1 Sportall365 may award points (“Points”) to a member whose membership currently gives access to the Service, for membership time and for use of the Service, under rules that Sportall365 sets and shows in the member’s account.
- 7.6.2 Points are an optional benefit provided free of charge. They are not part of the paid membership, no part of any membership payment is made for Points, and the membership price is the same with or without them. Points do not change any payment, cancellation or refund provision of these Terms.
- 7.6.3 Points have no cash value. They are not money, electronic money, a deposit, a credit or a means of payment. They cannot be exchanged, redeemed, refunded or paid out for money, money’s worth, credit or a price reduction, and they cannot be sold, transferred, shared, combined with another account or passed to anyone else.
- 7.6.4 Points are earned only during the current membership. A cancelled membership keeps its Points until the end of the period already paid for. When a membership ends, all Points earned during it lapse and can no longer be used, even if the account still displays them as inactive. A later membership starts with no earned Points, and lapsed Points are not restored.
- 7.6.5 No Points are awarded for a payment that is refunded, reversed, charged back or disputed. Points may be withheld while a payment dispute or a payment warning concerning the account is open. Sportall365 may withhold, correct or remove Points that were awarded in error, or where it reasonably suspects fraud, misuse, multiple accounts or a material breach of these Terms.
- 7.6.6 Sportall365 may at any time change how Points are earned, how many are awarded, the rules that apply to Points and what they can be used for, and may suspend or end the Points programme. Any legally required notice will be given in accordance with Section 21.
- 7.6.7 Any future use of Points will be governed by the rules published for it at that time. Nothing in these Terms promises that Points will have any particular use or value.
- 7.6.8 The lapse, correction, removal or withdrawal of Points, any change to how Points are earned or used, or the end of the Points programme, does not give rise to any refund, compensation, credit or other claim. Mandatory statutory consumer rights remain unaffected.
8. Account Security
You should protect your account credentials and Payment Method information. Do not provide passwords or sensitive payment information in response to suspicious communications. If you suspect unauthorised access to your account, notify Sportall365 promptly.
9. Age Requirement
You must be at least eighteen (18) years old or, where higher, the age required to enter into a binding subscription contract in your jurisdiction. By purchasing a membership, you confirm that you satisfy this requirement.
10. Responsibility for Misuse
To the extent permitted by applicable law, you are responsible for reasonable losses directly caused to Sportall365 or an applicable rights holder by your fraud, deliberate unlawful use of the Service, deliberate infringement of intellectual-property rights, or material breach of these Terms. Nothing in this Section makes you responsible for losses caused by Sportall365 or for liability that applicable consumer law does not permit Sportall365 to transfer to you.
11. Liability
11.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability, statutory right, or remedy that cannot lawfully be excluded or limited. Subject to the foregoing and to the fullest extent permitted by applicable law, Sportall365 is not responsible for losses that were not reasonably foreseeable when the contract was entered into, losses arising from commercial or business use of a consumer subscription, or losses caused by circumstances outside Sportall365’s reasonable control. Sportall365 is not responsible for any failure or interruption of the Service caused by your equipment, software, Internet connection, or bandwidth, or by any third party tampering with the Service. Where applicable law permits a monetary limitation for any other claim, Sportall365’s total liability will not exceed the amount you paid for the billing period in which the event giving rise to the claim occurred.
11.2 The Site may contain links to third-party websites or services outside our control. Sportall365 is not responsible for third-party services except where applicable law provides otherwise.
11.3 Editorial, statistical, recommendation, and informational materials supplied through Sportall365 are for general information and entertainment and do not constitute professional financial, legal, medical, betting, or other regulated advice.
12. Contact and Notices
12.1 You may contact Sportall365 about technical, billing, account, cancellation, or other matters at [email protected] or through the available Contact functionality. Sportall365 may request information reasonably necessary to identify the account or transaction and investigate the request.
12.2 You are responsible for keeping the email address associated with your account current, because notices under these Terms are sent to it.
12.3 Notices are sent to the most recent email address associated with your account or by another legally permitted method.
13. Third-Party Services
Third-party websites, software, payment services, applications, or other services may interact with or link to Sportall365. Those services may be governed by separate terms and privacy policies. Sportall365 is not responsible for third-party services it does not control except to the extent required by applicable law.
14. Events Outside Our Reasonable Control
To the extent permitted by law, Sportall365 will not be responsible for delay or failure caused by circumstances outside its reasonable control, including major telecommunications or hosting failures, malicious cyberattacks, governmental or regulatory action, war, civil disturbance, industrial action, severe weather, natural disasters, or failure of essential third-party infrastructure.
15. Waiver
A failure or delay by Sportall365 to exercise a contractual right or remedy does not waive that right or remedy. A waiver concerning one circumstance does not constitute a waiver concerning a later circumstance.
16. Third-Party Rights
A person who is not a party to the contract between you and Sportall365 has no right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999. This does not affect rights or remedies existing independently under applicable law.
17. Assignment
Sportall365 may assign or transfer its contractual rights or obligations in connection with a reorganisation, business transfer, outsourcing arrangement, or transfer of the Sportall365 Service. A personal consumer membership may not be transferred by the customer except with Sportall365’s consent or where applicable law provides otherwise.
18. Severability
If any provision of these Terms is determined to be invalid, unlawful, unfair, or unenforceable, that provision will cease to apply only to the minimum extent required by applicable law. The remaining provisions will continue in effect to the fullest extent permitted by law. Nothing in this Section permits an invalid provision to be applied in a manner that deprives a consumer of a mandatory legal protection.
19. Intellectual Property and Prohibited Use
19.1 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Service strictly in accordance with these Terms. You must not use the Site or Service unlawfully, fraudulently, maliciously, or in a manner that damages, disables, interferes with, or materially disrupts the Site or another user’s lawful use.
19.2 Content included in the Service, including text, graphics, logos, images, video, software, and compilations, is owned by or licensed to Sportall365 and is protected by applicable intellectual-property law.
19.3 Except where expressly permitted by applicable law or authorised by the relevant rights holder, you must not reproduce, publish, transmit, modify, sell, distribute, reverse engineer, create derivative works from, or commercially exploit protected Content.
20. Copyright Complaints
Sportall365 respects third-party intellectual-property rights. A rights holder who believes that material made available through Sportall365 infringes their rights should send to [email protected] sufficient information to identify the protected work, the allegedly infringing material and its location, the complaining party’s contact information, and the basis of the claimed rights, so that Sportall365 can assess and respond to the complaint.
21. Changes to These Terms
These Terms apply to all users, accounts, and memberships, including memberships that began before these Terms were published. Sportall365 may publish updated Terms of Service from time to time. Amendments affecting existing memberships will take effect only in accordance with Section 2.3 and applicable law. Publication of amended Terms does not, by itself, retrospectively change completed transactions, validate a payment that was not previously authorised, or remove accrued contractual or statutory consumer rights. Any legally required notice or consent will be respected. Where notice is required, Sportall365 may give it by email or by any other means. Continuing to use the Site or the Sportall365 Service, or keeping an account or membership, after updated Terms are published constitutes acceptance of the updated Terms.
22. Entire Agreement
These Terms, together with the Privacy Policy, constitute the contractual terms governing the Sportall365 Service. If any advertising, marketing, website, or checkout wording differs from these Terms, these Terms prevail. Nothing in this Section excludes a representation, right, obligation, or remedy that applicable law does not permit the parties to exclude.
23. Governing Law and Jurisdiction
23.1 These Terms and the contractual relationship between you and Sportall365 are governed by the laws of England and Wales.
23.2 If you are a consumer, the choice of the laws of England and Wales does not deprive you of any mandatory consumer protection that applies to you and cannot lawfully be excluded by contractual choice of law.
23.3 Subject to any mandatory jurisdiction rights available to a consumer under applicable law, the courts of England and Wales will have jurisdiction over disputes arising out of or relating to these Terms or the Sportall365 Service. Nothing in this Section prevents a consumer from bringing or defending proceedings before another court where mandatory applicable law gives that consumer the right to do so.
